When a complaint is filed against a public agency, IDEA ‘04 gives the public agency an opportunity to respond to the complaint. The public agency can either submit a proposal to resolve the complaint, or it can agree to voluntarily engage in mediation if a parent filed the complaint. Because of this new provision, the federally required 60 calendar day complaint timeline had to be rewritten to give the public agency time to respond to the complaint. What follows is an illustration of proposed Article 7 the 60 day complaint timeline.
Note: DOE means Department of Education and LEA means local educational agency (the local school corporation).
